By using the Services in any manner, including browsing the website, creating an account, logging a practice session, or using any feature, you represent that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Age Requirement. You must be at least 16 years of age to use the Services. If you are based in the European Economic Area or a jurisdiction with similar regulations, you may only use the Services if you are over the age at which you can lawfully provide consent to data processing under the laws of your country, or if verifiable parental consent has been provided.

MelodyLog is a practice logbook for musicians. You can log practice sessions, mark favorite composers and works, and watch your repertoire grow across a catalog of tens of thousands of composers and hundreds of thousands of works. The Services include the website, your private practice records, statistics, and the repertoire map.

2.1 How Practice Data Works

When you log a practice session, we store it on our servers and display it back to you — in your history, statistics, and repertoire map. Your practice logs and favorites are private to your account and are never shown to other users.

2.2 Free Service and Future Paid Features

The Services are currently provided free of charge. If we introduce paid features, we will update these Terms, publish pricing on the website, and notify registered users with reasonable notice before any charge applies.

2.3 Pre-release and Beta Features

We may designate certain Services or features as pre-release, beta, or experimental ("Pre-release Versions"). Pre-release Versions are provided "as-is," may contain defects, and are not guaranteed to be made generally available. We may discontinue or modify Pre-release Versions at any time without liability.

3.1 Ownership

You retain all rights and ownership of your practice logs, favorites, and any other content you submit through the Services ("User Content"). MelodyLog does not claim any ownership rights whatsoever in your User Content. We do not sell, license, or monetize your content.

3.2 Limited Access

Your practice logs are stored on our servers solely to provide the requested service: displaying your history, statistics, and repertoire map to you. Your User Content is not used for any other purpose and is handled in accordance with our Privacy Policy.

3.3 Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to submit the User Content through our Services;
• Your User Content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights;
• Your User Content does not contain malicious code, viruses, or illegal content;
• You are responsible for how you use the information and results provided by the Services.

4.1 MelodyLog IP

We (and our licensors) retain all right, title, and interest in and to the Services and Software, including all associated intellectual property rights, such as copyrights, trademarks, trade secrets, and proprietary algorithms, as well as the repertoire catalog, maps, and visualizations we provide. Nothing in these Terms grants you any right, title, or interest in the Services or Software except the limited license to use them as described herein.

4.2 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purposes. You may not:

• Copy, modify, decompile, reverse-engineer, or create derivative works of the Software;
• Resell, sublicense, rent, or lease the Services or Software to any third party;
• Use the Services or Software to build a competing product or service;
• Remove, obscure, or alter any proprietary notices or labels on the Services or Software.

4.3 Feedback

If you provide us with suggestions, ideas, or feedback about the Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our Services without any obligation or compensation to you.

5.1 Responsible Use

You agree to use the Services responsibly and lawfully. You must not misuse the Services in any way, including but not limited to:

• Using the Services to generate or distribute illegal, abusive, harassing, fraudulent, or infringing content;
• Attempting to gain unauthorized access to our systems, servers, or other users' accounts or data;
• Circumventing any security, access control, or usage restrictions we implement;
• Using automated means (bots, scrapers, etc.) to access the Services in a manner that imposes an unreasonable load on our infrastructure;
• Engaging in any activity that disrupts or interferes with the proper functioning of the Services.

5.2 Account Security

If you create an account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your credentials.

Our Privacy Policy describes how we collect, use, and safeguard personal data. By using the Services, you agree to the practices described in the Privacy Policy.

6.1 No Profiling

MelodyLog does not profile your practice data for advertising, marketing, or any purpose other than providing the specific functionality you request. We do not build user profiles based on the content of your practice logs.

6.2 Analytics

We may collect anonymized usage data (such as which pages and features are most popular and aggregate performance metrics) to improve the Services. This data does not include the content of your practice logs or any personally identifiable information derived from them.

The Services are currently free of charge, and no fees apply. If we introduce paid features in the future, current pricing will be published on the website, and we will notify registered users at least 30 days in advance via email before any charge applies. Your continued use after the price change takes effect constitutes acceptance of the new pricing. You are responsible for any fees charged by third parties in connection with your use of the Services, such as internet service provider fees or mobile data charges.

The Services may contain links to third-party websites, services, or resources that are not owned or controlled by MelodyLog. We are not responsible for the content, policies, or practices of any third-party services. You access them at your own risk, and we encourage you to review their respective terms and privacy policies.

9.1 "As-Is" Basis

THE SERVICES AND SOFTWARE ARE PROVIDED "AS-IS" AND "AS-AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and those arising from course of dealing or usage of trade.

9.2 No Guarantees

We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times. We do not guarantee that any defects will be corrected, or that the results obtained from using the Services will be accurate, complete, or reliable. You use the Services at your own discretion and risk.

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MELODYLOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, whether arising out of contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.

10.2 Cap on Liability

Our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid us for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US Dollars (US$ 100). This limitation applies regardless of the theory of liability and even if any limited remedy fails of its essential purpose.

10.3 Exceptions

Nothing in these Terms limits or excludes our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot lawfully be excluded or limited under applicable law.

11.1 Termination by You

You may stop using the Services at any time. To close your account and delete your practice data, contact us using the details in Section 15, and we will remove your account and associated data.

11.2 Termination by Us

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, including if:

• You breach any provision of these Terms;
• Your use of the Services creates risk or potential legal exposure for us;
• We are required to do so by law or regulatory authority;
• We decide to discontinue the Services, in whole or in part.

11.3 Survival

The provisions of these Terms that by their nature should survive termination, including ownership, intellectual property, disclaimers, and limitations of liability, shall continue to apply after any termination.

We may update these Terms from time to time to reflect changes in law, our Services, or our business practices. When we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Services after the effective date of the revised Terms constitutes acceptance of those changes.

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MelodyLog regarding the Services and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of MelodyLog.

14.4 Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may freely assign these Terms to any successor or affiliate in connection with a merger, acquisition, reorganization, or sale of assets.

14.5 Language

The English language version of these Terms shall be the controlling version for all purposes. Any translations are provided for convenience only.

14.6 Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, internet outages, or infrastructure failures.
